Terms of Use

1. About these terms

These terms apply to aimkinetic.com, the Aimkinetic client portal and the web design, hosting and maintenance services of AIMKINETIC SDN BHD (202501046949), Level 23-1, Premier Suite One, Mont Kiara, No 1, Jalan Kiara Mont Kiara, 50480 Kuala Lumpur (“Aimkinetic”, “we”). By creating an account or using our services you agree to them. A quotation you accept sets out the scope, price and timeline of your project; if it differs from these terms, the quotation prevails for that project. How we handle personal data is described in our privacy notice.

2. Your account

  • Give accurate details and keep them up to date. An account is for one person acting for themselves or for their organisation.
  • Keep your password and the sign-in codes we email you to yourself. You are responsible for what is done with your account. Tell us straight away at mellwvn@aimkinetic.com if you think someone else has used it.
  • We may suspend or close an account that is used to break these terms or the law, or that puts the service or other clients at risk.

3. Using the website and portal

Do not misuse the website or portal: no attempts to break in, overload it, copy it automatically, or upload malware or content that is unlawful or that you have no right to use. Information on the public website is general and may change; it is not an offer until we send you a quotation.

4. Briefs, AI design directions and previews

  • The design directions and homepage previews we prepare from your brief are created with the help of AI and reviewed by our team. They are proposals to choose from, not finished work.
  • AI output can contain mistakes and can resemble existing designs. Check what you are shown before you rely on it; we finalise the design with you during the project.
  • Only give us material you have the right to use, such as your logo, photos and text.

5. Quotations and acceptance

  • A quotation is valid for the number of days stated on it. Prices are in Malaysian Ringgit (RM) and include SST only where the quotation shows it.
  • Accepting a quotation in the portal (ticking the box and typing your name) is a binding order on the terms of that quotation, made on behalf of the organisation named in it. Make sure you are authorised to do so.
  • Work outside the accepted scope is quoted separately before we start it.

6. Invoices and payment

  • We invoice in the milestones stated in the quotation (normally a mobilisation payment before work starts and the rest at sign-off). Each invoice is due by the date shown on it.
  • You can pay online with Pay Now, which opens a secure payment page run by Stripe, or by bank transfer quoting the invoice number. Your card and online banking details go directly to Stripe; we never see or store them. An invoice is paid when the full amount reaches us.
  • We may pause work on a project while an invoice for it is overdue.

7. Subscriptions (hosting, domain, AI maintenance and plugins)

  • Subscriptions are billed in advance, monthly or yearly, at the prices in effect when the subscription starts. Deployment fees are billed once, on the first invoice. We tell you at least 30 days before a price change applies to you.
  • A subscription runs for the minimum term agreed when it starts, and then continues from period to period until it is cancelled. You can cancel by emailing mellwvn@aimkinetic.com; the cancellation takes effect at the end of the paid period, but not before the minimum term ends. Fees for the rest of the minimum term remain payable. Periods already paid are not refunded, except where the law requires it.
  • We remind you of an unpaid subscription invoice on its due date and again 7 days later. If it is still unpaid 14 days after the due date, AI maintenance, the AI content assistant and plugins are paused. Your website stays online. Everything resumes automatically once the overdue invoices are paid.
  • Domain names are registered in your name or your organisation's name where the registry allows it. A domain or hosting that is not renewed can expire and be lost; we are not responsible for that once you have cancelled or stopped paying for it.

8. Ownership of content and designs

  • You keep ownership of the content you give us, and you allow us to use it to deliver your project.
  • Once your project is paid in full, you own the final design and the content we created specifically for your website.
  • We keep ownership of our own tools, templates, code libraries and software, including the AI content assistant (mkadmin). You may use them as part of your website for as long as the related service runs. Fonts, images and other third-party material stay under their own licences.
  • We may show your finished website in our portfolio unless you ask us not to.

9. AI content assistant (mkadmin)

Your website may come with an AI chat that drafts changes to its text, images and pages. Every change is shown to you as a preview and is published only when you apply it. You are responsible for the changes you publish. The assistant is part of the AI maintenance subscription and pauses when that subscription is paused or ends.

10. Other providers

Parts of the service rely on other providers, such as hosting, domain registries, email, Stripe for payments and Anthropic for AI. Their own terms also apply to those parts. We are not responsible for their outages, but we will help you deal with them.

11. Liability

  • We deliver the service with reasonable care and skill. Apart from what these terms and your quotation say, the website, portal and services are provided as they are, and we do not promise they will be uninterrupted or error-free.
  • We are not liable for indirect or consequential loss, such as lost profit, revenue, data or business opportunity.
  • Our total liability to you for a project or subscription is limited to the amount you paid us for it in the 12 months before the claim.
  • Nothing in these terms limits liability that cannot be limited under Malaysian law, or your rights as a consumer under the Consumer Protection Act 1999 where it applies.

12. Changes to these terms

We publish changes on this page and update the date above. For significant changes we ask you to accept the new terms the next time you use the portal. Changes do not affect a quotation you have already accepted.

13. Law and disputes

These terms are governed by the laws of Malaysia, and the courts of Malaysia decide any dispute about them. Please contact us first at mellwvn@aimkinetic.com; most problems can be solved quickly that way.
